Construction Accidents
Construction injuries or deaths occur in a number of ways, and construction sites are one of the more dangerous working environments. These injuries and deaths can be caused by striking heavy objects, falling through unprotected spaces, and by heavy machinery mishaps. When an employee is injured on the job, his remedy against his employer is limited to his rights under the Workers Compensation laws. There laws are not designed to fully compensate the worker, but merely provide assistance during his time off by paying bills and a portion of his wages. The law is also designed to provide minimal compensation for any permanent condition caused by the work-related injury. Unfortunately, a workers compensation claim is the worker's exclusive remedy against his employer.
Therefore, if consulted about a construction site case, T&R will nvestigate the facts and circumstances to determine whether any non-employer was at fault. If so, the worker's rights against a negligent non-employer are generally unlimited, and the worker could assert a claim for full compensation against the negligent party or parties.
