According to National Academies of Science Institute of Medicine, in "To Error is Human: Building a Safer Health System," medical mistakes cause the deaths of over 90,000 people in the United States.

The National Academies of Science found that medical errors result in approximately 44,000 patient deaths per year. Other studies conducted place the number as high as 98,000 patient deaths per year. Conservatively, studies indicate that medical errors cause more patient deaths annually than do breast cancer, highway vehicle accidents, or AIDS.

National Academies of Science Institute of Medicine also states that studies show that over half of patients treated for congestive heart failure, hypertension, diabetes, and asthma do not get adequate medical care.

Medical Malpractice means action or inaction on the part of a health care provider that does not measure up to optimum standards of care. Some examples include:

  • Radiologists do not detect cancerous lesions;
  • Obstetrician misses fetal distress signs;
  • Family practitioner does not order cancer screening tests;
  • Surgeon doesn't see and treat post-surgical complication;
  • Orthopedic surgeon sets fractured bones incorrectly; or
  • Emergency room physician misses threat of pending heart attack.
